In the name of God, Amen.  I, John Bybee, of the county of Barren and state of Kentucky, being in good health and in perfect mind and memory, thanks be given to God, calling unto mind the mortality of my body and knowing that [it] is appointed for all men once to die, do make and ordain this my last will and testament, that is to say principally and first of all I give and recommend to the earth to be buried in decent Christian burial at the discretion of executors nothing doubting, but at the general resurrection I shall receive the same again by the mighty power of God, and as touching such worldly estate wherewith it has pleased God to bless me in this life, I give, demise, and dispose of the same in the following manner and form:

 First, I give and bequeath to my son, Sherod Bybee, a certain black horse.  To my son, Lee Bybee, a sorrel mare, also a cow and woman's saddle.  Also to my son, Sherod Bybee, two hundred acres of land head right, lying on Beaver Creek in the county and state aforesaid.  Also to my son, Lee Bybee, five dollars cash.

 The balance of my property I wish to be equally divided amongst all my children after my decease.  I likewise constitute, make, and ordain my son Sherod Bybee and Lee Bybee, the sole executors of this my last will and testa­ment, and I do hereby utterly disallow, revoke, and disannul all and every other former testaments, wills, legacies, bequeaths, and executors by me in any wise before named, willed, and bequeathed, ratifying and confirming in this and no other to be my last will and testament. 

 In witness whereof, I have hereun­to set my hand [156] and seal this fourteenth day of April in the year of our Lord one thousand eight hundred and twenty one.

 Signed, sealed, published, pronounced, and delivered by the said John Bybee as his last will and testament in the presence of us who in his presence and in the presence of each other have hereunto subscribed our names.

 The foregoing writing, purporting to be the last will and testament of John Bybee, deceased, was produced in court and B. T. Anderson, Stacy Bell, and Joseph Nevil, subscribing witnesses thereto, being sworn, deposeth and saith that the said John Bybee delivered the said writing for [his] last will and testament, and they believed him to be in his proper senses and memory when he did the same, and the said writing was ordered to be recorded as a true last will and testament of the said John Bybee, deceased.
