David A. Waller

In the name of God, Amen. I, David A. Waller of Barren County, Kentucky, being in feeble health but of sound mind and disposing memory and calling to mind the uncertainty of human life and being desirous to dispose of all such worldly estate as it hath pleased God to bless me with.

I give and bequeath the same in manner following, that is to say:

1st I desire that all my just debts and funeral expenses be paid .

2nd I give my sister Elizabeth S. Waller the trackt[ as written] of land I bought of T. H. Smith on which I now live, and bounded as follows; __

Beginning at a double chestnut running thence S 70 E 51 poles to a poplar and two white oaks thence N 15 E 108 poles to two black oaks thence N 70 W with W. W. Bells line 122 poles to a black walnut Thomas Balies[as written] corner thence with his line S 70 W 8 to a white oak thence N 76 W 15 poles to a maple thence S 53 W 12 poles to a white oak on the side of a road thence S 2 E 82 poles to a hickory on W, M Atkinson’s line, thence with his line S 65 E 86 poles to the beginning, containing 87 ½ acres more or less. I also give to my sister Elizabeth S. Waller the piece of land I bought of Mary Ann Fletcher containing one and a half acres. I also give and bequeath to my sister Elizabeth S. Waller the lands I bought of Margaret A. Bell and bounded as follows: __ Beginning at a white oak said Bells corner n D. A. Waller’s line running thence with said Waller’s line N 67 W 78 poles to a white oak on Waller’s spring branch thence N 4 E 32 poles to a black oak and two chestnuts thence N 82 ½ E 40 poles to a hickory thence N 71 E 36 poles to an elm on a branch thence up on the same S 72 E 38 poles to a white oak original corner thence with the original line S 34 W 78 pole s to the beginning, containing 33 acres more or less.

 

 


 

3rd After paying all my just debts and funeral expenses I give to my sister Elizabeth S. Waller all the money I have left.

4th I also give her one house and all my household and kitchen furniture

5th I desire that the 71 acres of land lying joining T. B. Waller’s land be sold and all of my personal property not heretofore named to sold and equally divided among my brother and sister , John H. Waller, T. B. Waller, H. J. Waller, E. S. Waller, Hiram S. Waller, Stephen W. Waller, and Martha J. Waller.

6th I also desire that my sister Elizabeth S. Waller be allowed twelve months provisions. I hereby revoke all other former wills or testaments by me heretofore made. In witness whereof I have hereunto set my seal

The foregoing instrument of writing purporting to be the last will and testament of David A. Waller, dec’d, was produced and filed in open court on above date and process in full by the oaths of W. B. Honeycutt and M. W. Atkinson, the subscribing witness thereto and ordered to be recorded as deed for the true last will and testament of said ___ Which is now done. Witness my hand this 22nd day of July 1891.
